Nintendo no doubt that the decision has come too late to increase sales of DS, however - as it prepares to launch the wonderful 3DS in the UK.
It's become an extremely dangerous place for pirates of the DS. Several months ago, Nintendo decided to sue some of the larger firms DS piracy out there, and even ended up causing a huge boost to sales of these companies, it seems that the big N is starting to crack down on distributors as well.
GadgetGear (no affiliation with your server) was selling the R4 flash cartridge, which can be used to breech homebrew applications, games, and of course pirated ROM on your device. The key word was not, because Nintendo has successfully sued the bejeezus of them, resulting in hundreds of thousands in damages paid, and of course an agreement not to sell the banned product.
In this case, the hardware manufacturers are reviewing the card route to take to get into the hands of the modders. You can close the operations of the trust in a place where there are laws, such as Australia, but what about the shadow eBay store or electronics store that operates from a place where Nintendo is not competent?
How things like the r4 for the ds is in the U.S. changes after the DMCA, I'm not sure. I guess I should show that they were using completely R4 homebrew software to run second that I see no harm in that.
