The import, sale or advertising of the R4 sdhc card
The import, sale or advertising of the R4 sdhc card, sometimes (often?) Is used to pirate DS games, it is now illegal in the UK. The defendants tried to argue that the R4 should not be demonized, much less illegal, and can also be used to play homebrew software. The Supreme Court disagreed.
Nintendo released a statement after the decision:
In the UK, has been more than 100,000 sided copying devices since 2009. Nintendo initiates these actions not only on its own behalf but on behalf of more than 1,400 video game development companies that depend on legitimate sales of games for their survival.
For the unfamiliar: the R4 and other devices as they are essentially "blank" for the Nintendo nintendo r4 DS game cards. Users can load the card with homebrew software independent games and stuff, but you can also load the card with software piracy. (The Pirates of DS games are incredibly easy to find and download.) Nintendo says most people buy the devices do not play homebrew software, but to play Dragon Quest IX, without paying for it.
Nintendo has been struggling against things like the R4 for several years. This is one of the greatest victories in that fight.Watch out illegal games retail unreliable - the piracy-enabling R4 DS is now officially illegal in the UK.
A new ruling by the High Court in London has been officially banned the import of advertising, or sale of r4 for nintendo cartridges cards. The - which was banned in Japan in February - allows DS owners to transfer digital games downloaded to a PC to the console, including the tightening of the Torrent and P2P sites.
The card cartridge and the like have been charged with a sharp drop in sales of Nintendo DS software. According to industry site MCV, limited playable defendant argued the legality of the R4 at the base that allows homebrew applications. However, the Court ruled that the R4 Nintendo should be circumvent security systems before they can work, therefore is illegal.
"Nintendo promotes and encourages the development of play and creativity, and strongly supports the game developers who legitimately create new innovative applications," said a statement from Nintendo. "In the UK, has over 100,000 sided copying devices since 2009.
"Nintendo initiates these actions not only on its own behalf but on behalf of more than 1,400 video game development companies that depend on legitimate sales of games for their survival."
Nintendo no doubt that the decision has come too late to increase sales of DS, however - as it prepares to launch the wonderful 3DS in the UK.
It's become an extremely dangerous place for pirates of the DS. Several months ago, Nintendo decided to sue some of the larger firms r4i gold piracy out there, and even ended up causing a huge boost to sales of these companies, it seems that the big N is starting to crack down on distributors as well.
GadgetGear (no affiliation with your server) was selling the R4 flash cartridge, which can be used to breech homebrew applications, games, and of course pirated ROM on your device. The key word was not, because Nintendo has successfully sued the bejeezus of them, resulting in hundreds of thousands in damages paid, and of course an agreement not to sell the banned product.
In this case, the hardware manufacturers are reviewing the card route to take to get into the hands of the modders. You can close the operations of the trust in a place where there are laws, such as Australia, but what about the shadow or eBay store electronics retailer that operates from a place where Nintendo is not competent?
How things like the r4 nintendo is in the U.S. changes after the DMCA, I'm not sure. I guess I should show that they were using completely R4 to run homebrew software you really do not see the harm in that.
